Where we are unable to resolve your dispute using methods outside of the courtroom, we will proceed to litigate. In Scotland, commercial disputes are heard in either the Sheriff Court or the Court of Session. Claims with a value of over £5,000 follow what is known as the Ordinary Cause procedure, and those under £5,000 follow the Summary Cause procedure.

There is also a simple procedure which may be used to cut down the time it takes to settle your dispute, and we will explore this option where it is available to you. The simple procedure can be used where the value of the claim is less than £5,000 and for delivery or possession of moveable property (such as goods).

High-value cases may also be heard in the Court of Session Commercial Court, which has its own set of rules and procedures. The process in this court is generally much quicker, and the judge has broader discretion to settle disputes.
